Terms of Service & Policies

These Terms of Service and Policies (the "Terms") govern your use of theluxepour.com (the "Site") and your engagement of private bartending services from The Luxe Pour Affair ("we," "us," or "our"). By using the Site or booking our services, you agree to these Terms. Booked events are additionally governed by a signed Service Agreement; where these Terms and a signed Service Agreement differ, the Service Agreement controls.
1. Our services
The Luxe Pour Affair provides private mobile bartending services in the Greater Boston area, including TIPS-certified bartenders, styled bar setups, bar equipment, mixers, fresh juice, soft drinks, garnishes, service ware, and setup and breakdown, as described in the client's selected collection.
2. Dry-hire model
We operate as a dry-hire service in accordance with Massachusetts law. We do not sell, supply, or furnish alcoholic beverages. Clients purchase and provide all alcohol for their events; we provide a customized drink menu, alcohol selection guidance, and a detailed shopping list to assist. All alcohol served must be owned by the client and provided to guests without charge; no sale of alcohol may occur at any event we serve.
3. Quotes and estimates
- Figures produced by the estimate builder on our Packages page are estimates only and do not constitute a binding offer. Final pricing is confirmed in a written quote.
- Written quotes are valid for fourteen (14) days from the date of issue unless otherwise stated.
- Published pricing may change; confirmed bookings are honored at their contracted price.
4. Booking, deposits, and payment
- A date is reserved only upon our receipt of a signed Service Agreement and a deposit of fifty percent (50%) of the total.
- The remaining balance is due four (4) weeks prior to the event date.
- No service charge, administrative fee, or gratuity is added to our pricing.
5. Guest counts
- Each collection includes a stated guest count: The Aperitif, up to 40 guests; The Soirée, up to 75 guests; The Affair, up to 120 guests.
- Additional guests are billed at $15 per guest, reflecting the additional mixers, ice, juice, garnishes, and service ware required.
- Final guest counts are due four (4) weeks prior to the event. Guests attending in excess of the confirmed count are invoiced following the event.
- Events exceeding 120 guests are quoted individually.
6. Gratuity
Our bartenders are compensated in full by The Luxe Pour Affair. No gratuity is charged to clients, and none is expected of clients or their guests. A tip jar is placed on the bar for guests who wish to thank the bartending team directly; any such gratuities are voluntary, given at guests' sole discretion, and received by the bartending team.
7. Cancellation and rescheduling
- Deposits are non-refundable.
- Cancellations made thirty (30) days or more before the event incur no charge beyond the deposit.
- Cancellations made fewer than thirty (30) days before the event require payment of the full balance.
- Events may be rescheduled once, without penalty, to a mutually agreeable date within twelve (12) months, subject to availability, with at least thirty (30) days' notice.
8. Responsible service
- All bartenders are TIPS-certified.
- We reserve the sole right to refuse service to any guest who appears intoxicated, cannot produce valid identification, or is under twenty-one (21) years of age. Clients agree to support these decisions.
- We reserve the right to suspend or discontinue service, without refund, in the event of unsafe conditions, harassment of staff, or unlawful conduct.
9. Client responsibilities
- Purchasing and providing all alcohol for the event;
- Securing venue permissions, access, and any permits required for bar service at the venue;
- Providing a level bar area of approximately six feet by four feet, with reasonable load-in access;
- For outdoor events, providing adequate cover or shade for the bar area;
- The cost of repair or replacement of our equipment or property damaged by the client or the client's guests.
10. Insurance
We carry general liability and liquor liability insurance. Certificates of insurance are available upon request for venues that require them.
11. Intellectual property
All content on the Site — including text, photographs, design, logos, and the names The Luxe Pour Affair, The Aperitif, The Soirée, and The Affair — is our property or used with permission, and may not be copied, reproduced, or used commercially without our prior written consent.
12. Acceptable use of the Site
You agree not to misuse the Site, including by attempting to interfere with its operation, submitting false or misleading inquiries, scraping content, or using the Site for any unlawful purpose.
13. Disclaimers
The Site and its content are provided "as is" and for general information. While we work to keep information current and accurate, we make no warranties, express or implied, regarding the Site's availability, accuracy, or fitness for a particular purpose.
14. Limitation of liability
To the fullest extent permitted by law, The Luxe Pour Affair shall not be liable for indirect, incidental, special, or consequential damages arising from use of the Site or our services. We are not liable for the conduct of event guests, nor for any injury or loss arising from the consumption of alcohol provided by the client, except to the extent caused by our negligence. Our total liability for any claim shall not exceed the amount paid to us for the event giving rise to the claim.
15. Force majeure
Neither party is liable for failure to perform due to circumstances beyond reasonable control, including severe weather, illness, government restriction, or venue closure. In such an event, the parties will reschedule in good faith.
16. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any dispute shall be brought in the state or federal courts located in Massachusetts.
17. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
